PERK’s lawsuit heads to Jury Trial

Exciting news has emerged in the legal landscape: PERK’s lawsuit filed on behalf of dedicated teachers and committed educators is heading toward a jury trial. The pivotal case that PERK, alongside the five fired employees, filed against Granada Hills Charter is officially set for trial on November 4th, 2024.

ABOUT THE LAWSUIT (Complaint Filed)

Five employees of Granada Hills Charter (GHC) were unfairly terminated during the Covid-19 pandemic for simply exercising their rights to medical and religious freedom.   These school employees were the first in California and possibly the nation to lose their jobs due to the mandate.

Granada Hills Charter School has been egregious in implementing illegal vaccination policies on four points.

  1. Five educators were unfairly and unlawfully terminated. 

  2. Granada Hills Charter went on to force students who were unvaccinated against Covid-19 into independent study. 

  3. PERK learned that students, including seniors, were excluded from in-person learning based on their vaccination status for Covid-19.

  4. PERK was informed that the school went as far as excluding seniors from Prom and did not allow them to attend their in-person graduation ceremony, based solely on their vaccination status for Covid-19.

These actions taken against students and educators were completely unreasonable and unjustified. PERK has been advocating for students, families and teachers at GHC, as a result, decided to take legal action against the school on behalf of the faculty and staff that were fired over the COVID-19 Vaccine Mandate. On January 14, 2022, Protection of the Educational Rights of Kids (PERK) and the five individuals collectively filed a lawsuit against the individual Brian Bauer, Superintendent of GHC, as well as GHC itself. The plaintiffs filed a comprehensive complaint seeking declaratory and injunctive relief, alongside damages resulting from violations of their civil rights. They also requested a jury trial to adjudicate their grievances. The legal representation for PERK and the plaintiffs comes from Attorney John Howard and Attorney Scott Street, both affiliated with JW Howard Attorneys, LTD.  The complaint has been amended several times and in a significant development, the case has finally been set for trial on November 4th, 2024, marking an important date in the pursuit of justice.

What an exhilarating event it was! With engaging presenters, insightful panels, a bustling exhibit hall, special events, and interviews with the news media, PERK truly made an impact at Freedom Fest 24! Presenting at this year's Freedom Fest in Las Vegas, PERK spotlighted the victories and obstacles in California. With a large attendance of thousands, PERK successfully communicated the message that California is not beyond redemption; there is still a flicker of hope.

Freedom Fest was a great opportunity to connect with numerous individuals, sharing our values, mission, and activities. At a booth alongside ICAN and The Highwire, PERK participated in sharing our mission to fight against vaccine mandates, champion parental and children's rights, and highlight the importance of standing up for California. Amy Bohn, the President of PERK, took the main stage to convey a message of optimism, emphasizing that California is a winnable cause. As a California resident and host of Freedom Fest, Kennedy expressed that Amy's message brings hope to the audience.

Amy also conducted a breakout session where attendees discovered the ways in which PERK and its supporters are leaving a positive impact in California. The opportunity to connect with comedian Rob Schneider, who incorporates truth into his performances, was a notable highlight. Congressmember Thomas Massie introduced a bill to combat COVID vaccine mandates, while Congressmember Warren Davidson is actively supporting veterans who have been injured by vaccines. Engagements with advocates and authors such as Adam Coleman, Thomas Woods Jr., PhD, and Finlay Beach provided valuable insights and connections, paving the way for the expansion of our movement.

July Call To Action!

The state legislators are on summer break from Sacramento during the month of July. During this time they often host in-district events to meet their constituents. This is a great opportunity to meet with your legislator and listen to what they care about. Let them know what matters to you and how you would want them to stand on an issue-like vaccine mandates. This is a great opportunity to ask for a meeting and share your experiences to enlighten them about the impacts vaccines and mandates have had on your family. How has it impacted your relationships, your mental health, your income, your livelihood? Your story matters. 

Participating in this call to action will add a layer of impact to our advocacy efforts sending first responders to the capitol to share their own experiences. Now is the time to tell your story. Call your legislator’s office and ask for an opportunity to meet with your legislator to talk about your concerns as a constituent and as a parent. They are in their district offices through the month of July, and Fridays during the legislative session. When in a meeting with your legislator, you can share your concerns as a parent, an employee, business owner, student, or whatever capacity vaccine requirements have caused unnecessary discrimination and exclusion. PERK making a difference in Geneva!

It has been an exciting and memorable weekend in Geneva, Switzerland! It was incredible.  I had people come up to me from at least 5 other countries, who knew of PERK, and saw my videos, interviews, and the success of PERK in California.  I was surprised that our efforts in California have reached international freedom fighters.  Our credibility is high, and we are giving hope to freedom fighters all over the world.   When they’ve seen or heard of our victories, it’s been encouraging to them as well.  Some countries, like Italy, Switzerland, Germany, Austria, and the UK, offer their support for PERK. I interacted with physicians from Mexico, researchers from Canada, experts from the UK, and various international figures eager to collaborate with PERK.

At the Inspired Network Global Leadership Summit, thousands of people zoomed in, to connect with us in Geneva.  In Japan, they were also protesting the WHO simultaneously with us.  We all shared a comradery for freedom that surpassed geography and culture.

 After the leadership summit, the next morning was a International Lawyers press conference led by Attorney Phillip Kruse.  He is an expert on the WHO issue and he and his team pulled together 10 international attorneys from 9 different countries (i.e. Israel, New Zealand, Switzerland, Germany). I had the opportunity to talk to several of them afterwards and record those brief conversations.  The PERK team will be working on releasing those videos to you all.  These international attorneys also offered to support PERK and getting this message out to everyone.

The Gates Foundation was holding a meeting in the same hotel.  I could not believe it.  They were just around the corner from the 10 attorneys, who held a press conference in opposition to the WHO.  You cannot make this up.  I had to take a picture.

This is a symbol that we are winning! The people of the world are waking up and fighting back against any group who tries to undermine our sovereignty.  The analysis of the international attorneys was quite sobering.  Their resounding answer to solve this problem of our day was for the people to rise, be aware, send letters to your representatives, and protect our countries at all costs.

Immediately following the press conference, we hurried to the International Freedom Rally.  There, with the United Nations behind me, I had the opportunity to deliver a message about being “Born Ready” for this moment to the thousands in attendance and the millions watching online.  You can watch me backstage with behind the scenes footage and you can see my full speech here!

It was so meaningful to have my family there and see the faces of an eager crowd motivated to protect their families, their rights, and their country.  I stood alongside them as we demonstrated, with a 2-hour people’s march for freedom.  The march was so loud and invigorating as it included drums, freedom chants, and bells, and most importantly, people from around the globe marching for freedom.

During the Geneva Rally, it was announced that the WHO's pandemic treaty collapsed as member states couldn't agree. It won't be adopted at World Health Assembly. This is a victory for freedom advocates against WHO's pandemic control proposal.

The head of the World Health Organization on Monday voiced confidence that countries would one day reach a deal on a pandemic accord after failing to produce an agreement last week, although health officials warned it could take years.

Health officials have voiced frustration with the negotiations that have been dogged by lengthy discussions past midnight, last-minute shifts in position and growing criticism from right-wing commentators that the treaty would undermine sovereignty, which the WHO strongly denies. - CTV News

The WHO updated International Health Regulations before the deadline, seen as important. Critics noted that the final version didn't address concerns from health freedom advocates. After the World Health Assembly, WHO said the changes aim to enhance global health protection against future outbreaks. Legal concerns arise as the new IHR changes were proposed shortly before the Assembly, not following current rules. The final version was released on June 1 after voting just before the Assembly ended. WHO member states view the adoption of the diluted IHR amendments as significant progress and a win for the United States and others who led the process in 2021.

AB 1955 Signed Into Law!

Despite the cries of protest and thousands of opposition letters from parents across the state of California, Governor Newsom signed AB 1955 into law on July 15th, 2024. AB 1955 by Assemblymember Ward, was a "gut and amend" bill aimed at legally prohibiting any school employee, teacher or contractor from disclosing "any information related to a pupil’s sexual orientation, gender identity, or gender expression to any other person without the pupil’s consent." This controversial bill has sparked backlash due to its implications on parental rights and children's well-being. It was championed by the Attorney General of California, Rob Bonta, who lacked legal grounds within state law to pursue legal action against pro-family school boards advocating for parental rights policies concerning gender-confused children. This law will go into effect January 1st. 2025.

Good news is that Liberty Justice Center has already filed a lawsuit to turnover this new law set to take effect Jan, 2025.
