The pressure is on because Senator Weiner needs 41 Ayes to pass SB866 out of the Assembly House.

SB866 Legal Announcement - June 21, 2022

Dear PERK Members, 

We have an important announcement to make regarding SB866. As you know, the PERK team has been aggressively fighting to stop SB866, the minor consent bill, from becoming law.  Our efforts have included a multi-faceted strategy that we have executed on for over 5 months. 

  • We sent over 130,000 digital postcards to tens of thousands of constituents in key Assembly Member Districts.

  • We launched an email campaign to all Assembly Members to abstain/oppose the bill.

  • We anticipated the bill could quickly move to the Governor’s desk and preempted this with another campaign requesting a veto.

  • We have been working closely with groups, including Attorney Nicole Pearson from Facts Law Truth Justice, and have prepared legal analysis, joint rebuttals, and strategic folders.

  • We have flown to Sacramento, almost weekly, to fight for you and the children of California.

  • We have joined forces on initiatives and projects with many wonderful organizations in unison and with purpose to defeat this bill.

  • We have trained and coached many of you for district meetings.  We have provided you resources, talking points, graphics, and materials to support your voice.

  • Out of necessity, some strategies have remained confidential to protect our ability to defeat the bill.

  • We have led you, the people, with weekly, and sometimes daily calls to action.

 In January, we anticipated some of the California bills, if passed, may require legal action.  We have been preparing for this for 5 months.  Appropriately, the PERK team has alerted organizations who may be best fitted for legal action on certain bills. 

Last month, we were blessed and grateful to work with ICAN, who at a critical juncture with SB866, directed Aaron Siri to send co-sponsored legal letters on behalf of ICAN and PERK.  These legal letters were sent to Governor Newsom, The Assembly Committee on Rules, The Assembly Judiciary Committee, and all Assembly Members.

Though we feel confident that our relentless efforts at the capitol have shifted enough votes away from SB866 to block its passage, we all know how fast things can change inside the California Capitol.  That is why we are excited to announce the following: 

If SB866 passes the Assembly Floor and becomes California Law, ICAN and PERK are prepared to take swift legal action together.  We have kept this confidential until now.  We believe this is the best decision to protect California’s children.  We will work under the direction and leadership of ICAN and their lead counsel, Aaron Siri, who recently won a similar ‘minor consent case’ in Washington D.C.

Keep the pressure on!


June 6th, 2022



What an adventure today at the California capitol! We have a lot to share. Monday, we were prepared, in case SB866 was voted on the assembly floor. It was in the daily file, however, SB866 was not voted on today.

We see this as a very positive thing.

It’s possible they didn’t have enough votes to pass the bill. It’s also possible tomorrow’s primaries were a factor. We discussed this with many assembly members and capitol staff, who agreed with both possible reasons.

The best part of this day was the coordinated effort among a group of us, who met with Assembly Member after Assembly Member, who publicly told us they were a “NO” or “ABSTAIN” on this bill. At least 10 were Democrats!

The day started with Attorney Nicole Pearson sitting on the airplane flight to Sacramento with 4 legislators, including Assemblywomen Quirk Silva and Davies! Assembly member Silva had in hand the incredible folder PERK and FLTJ put together analyzing the bill. We hand delivered this folder to dozens of legislators, over the past few weeks.

Here are the encouraging results, as you, the people of California, are taking action, with us, and pushing back on SB866:

Your district meetings worked and influenced votes. Keep it up!

The action link PERK sent out on Friday, as of this moment, has almost 6,000 submissions from constituents, which has sent over 480,000 emails to the CA Assembly Members! Please keep sharing.

Other Assembly Members are still on the fence. We cannot let up! We started an email campaign for the Governor, as well, because, we are all tired of waiting and being reactionary. We are going on the offensive. If this bill had actually passed today, it could have been at the Governor’s desk in minutes. We are not willing to sit back and wait for amendments. Past amendments have only made more problems for the future. Frankly, there aren’t any amendments that will make this bill better, nor will amendments truly protect all of California children!

This bill could be brought to the floor on Thursday. However, the next most likely day would be next Monday.

We are fighting with everything we have. You are all standing side by side, with us, to defeat this bill! We can do this. The action steps remain!

It could be voted on by the full Assembly as early as Monday June 6th! Tell Assembly members to vote NO or ABSTAIN on SB 866!

We are asking for all people and organizations in California to take action. In addition to calling and emailing, we are encouraging people to respectfully go to your state Assembly member's district office this Friday, June 3. Appeal to their heart, emotions, and sound reason. First and foremost, you are a concerned parent and constituent. As you may already know, SB866 passed the Assembly Judiciary Committee on Wednesday with bipartisan opposition. Note: Principal coauthor Assemblywoman Buffy Wicks, not normally on the Judiciary Committee, was placed in the vacant Democrat seat, ensuring the extra vote needed to pass this committee. SB866 could be brought to the Assembly floor for vote as soon as this Monday.

NOW is the time to act. SB866 is a bill that will allow minors 12+ to be vaccinated without parent knowledge and consent. Bill authors reason that this is just expanding the health rights that minors already have. But really, this bill exposes children to unnecessary risk and coercion.

 

On Friday, June 3rd Legislators will be in their local offices.

1. Print out info graphics and handouts. We have provided templates to print off if needed.

2. Bring these documents to your state assembly members at their district offices. Find their information here: https://findyourrep.legislature.ca.gov

  • If your Assembly member is not available, you may ask to speak with the district director or staffer in charge of SB866. Ask for their business card and for them to confirm with you that your documents are hand delivered to your Assembly member.

3. Ask them to vote no or abstain on SB866 on the Assembly floor.

Tell them:

  • The bill is illegal and violates Federal Law. The bill is already being targeted for litigation if it passes, as a similar bill from last year in Washington DC was struck down by a Federal Judge, without appeal.

  • This bill does not uphold democratic values. We want to uplift and empower women, but this bill silences women as mothers. This bill will also have the most impact on minority communities, assuming they cannot be educated to make the best decisions for their children.

  • Parents of adolescents know that when their children get sick, they ask their parents for help. Any medical care children can get without parent consent is only for issues that need immediate care. Legislators have already shown the science regarding vaping: Children are not capable of making sound risk/benefit decisions without being influenced by peer pressure and coercion.

     

Tips:

First and foremost, you are a concerned constituent and/or parent. Appeal to your legislator by presenting yourself in a calm, concerned manner, and win them over by having them connect with the concerns you present.

Ask your legislator to vote no or abstain on SB866 on the assembly floor. We do not recommend asking for amendments to this bill. Click here for numerous resources, graphics, templates, and support for you to utilize if you choose.

If you cannot respectfully present your concerns to your legislator in person (I.E.: you feel strong emotions that can lead to emotional or aggressive outburst), it may be a better option to call their local office and ask for the district director or legislative director. Ask for their email address so you can send a PDF copy of the info graphic and documents along with your ask to vote no or abstain on SB866 on the assembly floor. The goal is to win them over, and move them to vote in our favor.
